US Patent Office Declares Generative AI a Tool for Modern Inventors

In a significant update, the US Patent and Trademark Office (USPTO) has clarified its stance on generative AI, stating that it is akin to other tools in an inventor’s toolkit, such as lab equipment and software. USPTO Director John Squires emphasized that while generative AI systems cannot be considered inventors under US patent laws, they are valuable instruments that can aid human inventors in creating innovations.

Squires noted, “AI systems, including generative AI and other computational models, are instruments used by human inventors.” He explained that these systems generate ideas and provide services but ultimately remain tools for the inventors who conceive the inventions. This perspective aims to integrate generative AI more effectively into the patent process, reflecting its growing role in innovation.

The updated guidelines, which will be published in the Federal Register soon, also clarified that there will be no separate evaluation process for AI-assisted inventions. Traditional joint inventorship principles still apply when multiple individuals participate in the creation of an invention with AI assistance. This adheres to a ruling by the Court of Appeals for the Federal Circuit, affirming that only natural persons can be named as inventors.

This development opens doors for advancements in various fields, including pharmaceuticals and technology, as it offers more clarity regarding the patentability of inventions developed with generative AI.
