Texas Hit with a Pair of Lawsuits for Its App Store Age Verification Requirements

Texas is facing significant legal challenges due to its newly enacted age verification law for app stores, set to take effect on January 1. The Computer & Communications Industry Association (CCIA) has filed a lawsuit asserting that the Texas App Store Accountability Act infringes on First Amendment rights. The CCIA, which represents tech giants such as Amazon, Apple, and Google, argues that the law restricts access to lawful content and imposes undue burdens on app developers.

Under this law, app store users must verify their age before downloading apps or making in-app purchases. If users are underage, they must secure parental consent for each transaction. This not only affects users but also places additional responsibilities on developers, who are required to implement “age-ratings” for their apps.

Stephanie Joyce, CCIA’s senior vice president, emphasized, “This Texas law violates the First Amendment by restricting app stores from offering lawful content.” She indicated that the law mandates app developers to present their offerings in a manner that aligns with state preferences.

In a parallel move, the student advocacy group Students Engaged in Advancing Texas (SEAT) has launched a similar lawsuit, claiming that the law imposes extensive restrictions on protected speech and information. The law firm representing SEAT raised concerns about the potential risks of collecting personal information, including government IDs, for identity verification.

As Texas prepares for the new year, the impending legal battles highlight a growing tension between state legislation aimed at protecting minors and the technological landscape’s commitment to user privacy and informational freedom.
