WordPress Co-founder Files Countersuit Against WP Engine Over Trademark Violations

In a significant legal development, Matt Mullenweg, co-founder of WordPress and CEO of Automattic, has launched a countersuit against the hosting provider WP Engine. This countersuit arises amid a broader legal dispute that began when WP Engine accused Automattic of abuse of power and extortion. The core of Mullenweg’s counterclaim alleges that WP Engine has violated WordPress trademarks since receiving a $250 million investment from Silver Lake, which gave the firm controlling interest.

Automattic contends that WP Engine misrepresented itself as the “WordPress Technology Company” and allowed partners to refer to it as “WordPress Engine.” Such actions are believed to mislead users while undermining the community-driven ethos of WordPress. Mullenweg’s legal team argues that WP Engine failed to fulfill its commitment to allocate resources to support the open-source project, contravening agreements made during partnerships.

In an official statement, a representative from WP Engine asserted that their use of the WordPress trademark aligns with established industry practices and fair use, vowing to contest what they deem baseless claims from Automattic. The company’s lawsuit claimed that Mullenweg sought a staggering eight percent of their monthly revenue as a licensing fee, a proposition that led to significant unrest within Automattic, resulting in over 100 employees voluntarily leaving.
