California Enacts Age-Gate Law for App Stores

California has officially joined the ranks of states implementing regulations for app stores by enacting AB 1043, a significant age-gate law. Signed by Governor Gavin Newsom, this legislation seeks to enhance the protection of minors online by requiring app stores to categorize users based on age. In contrast to similar laws passed in states like Utah and Texas, which often require parental consent for app downloads, California’s law allows children to download apps independently. Instead, parents will enter their child’s age when setting up devices, enabling app developers to better understand their user base.

The overwhelming support for AB 1043 was evident when it passed with a unanimous vote of 58-0 in the State Assembly. Tech giants such as Google, OpenAI, Meta, Snap, and Pinterest voiced their backing for the bill, positing that it strikes a more balanced approach to age verification while offering greater privacy protections than other states’ legislations.

As California prepares to enforce this age-gate law, it also plans to implement additional measures addressing concerns over social media and chatbot use among minors. New laws require social media platforms to display warning labels regarding potential risks to children and mandate AI chatbots to prevent the promotion of self-harm.
